What Is California Maternity Leave?

California maternity leave isn't one program — it's a combination of overlapping state, federal, and employer benefits that, when coordinated correctly, can provide significant paid time off and job protection for new parents.

California Maternity Leave

California Maternity Leave Programs, Explained

State Disability Insurance (SDI)

SDI provides partial wage replacement when you're unable to work due to a medical condition — including pregnancy and postpartum recovery.

Birthing parents can begin collecting SDI at 36 weeks pregnant. After delivery, SDI covers six weeks for a vaginal birth or eight weeks for a cesarean. In 2026, SDI pays 70–90% of your wages up to a maximum weekly benefit of $1,765.

SDI is funded through your California paycheck. You've already been paying into it. This is your money.

Paid Family Leave (PFL)

Once SDI ends, Paid Family Leave kicks in. PFL provides up to eight weeks of paid benefits — also at 70–90% of your wages — to bond with a new child following birth, adoption, or foster placement.

PFL must be used within the first 12 months after your child arrives. Non-birthing parents and partners are also eligible.

California Family Rights Act (CFRA)

CFRA provides up to 12 weeks of job-protected leave to bond with your child. Job-protected means your employer must hold your position — or a comparable one — until you return.

CFRA is unpaid on its own, but it typically runs concurrently with PFL, meaning you receive pay through PFL while your job is protected under CFRA.

Pregnancy Disability Leave (PDL)

PDL provides up to 17.3 weeks of job-protected leave for the period you're disabled by pregnancy, childbirth, or related conditions. It runs concurrently with FMLA but is separate from CFRA — meaning birthing parents may be entitled to PDL protections in addition to their CFRA entitlement.

Family and Medical Leave Act (FMLA)

The federal FMLA provides up to 12 weeks of unpaid, job-protected leave within a 12-month period. In California, FMLA typically runs concurrently with PDL.


How California Maternity Leave Programs Stack Together
